An attorney and counselor at law as well as a CPA, Tim is one of only a handful of agents with such credentials. He has been certified by the NFLPA since 2001 and has represented such NFL players as Pro Bowler Joe Johnson and current partner and super Bowl champion Barrett Brooks. Prior to joining together with Andre Coleman and Barrett Brooks to form New Era Sports Consultants, Tim served on the Board of Directors of the Institute of Sports Attorneys (ISA), established by Ed Garvey, the founder of the NFL Players Association. While working with Garvey, Tim established a sports consulting firm in Kansas City dedicated to the mission of bringing a higher level of integrity and professionalism to NFL player representation.

Prior to his sports consulting career, Tim directed the personal financial planning/wealth management practice at the Oklahoma City office of KPMG Peat Marwick, one of the largest and most prestigious tax-consulting firms in the world. In that capacity, Tim worked hand in hand with professional athletes, top executives of major corporations, and other wealthy individuals to assure that they saved more of what they earned, maximized their net worth, and planned for the overall financial security of their families future generations. Tim has extensive experience in the areas of income tax planning, estate planning, private foundations and charitable trusts.

Tim is a member of the American Society of Certified Public Accountants, the American Bar Association and is a member of the Missouri Bar. He was selected by the Oklahoma Society of CPAs to serve on the Personal Financial Planning Steering Committee for the State of Oklahoma. Tim transferred from Davidson College in North Carolina to attend the University of Missouri-Columbia where he received a B.S. degree in Accounting. He earned a law degree from the University of Missouri-Kansas City.

Tim grew up in Carthage, Missouri and attended high school in Boca Raton, Florida. As a student-athlete, Tim received varsity letters in five sports in high school and college. He received several all-area and academic all-area honors and awards in high school, finished 4th in the state of Florida in the high-jump, won a gold medal in Junior Olympics competition and once, after starting at third base for his high school baseball team, changed uniforms and set a school high-jump record on the same afternoon.

Andre is originally from Charlotte, North Carolina. He later moved to Hermitage, Pennsylvania where he became a 1st Team All-State running back at Hickory High School. Andre rushed for a record breaking 3,700 yards and 64 touchdowns in his final two seasons and was named 1990 Pennsylvania State Player of the Year. He led Hickory High School to it’s first Class AA State Championship in school history.

Andre received a full scholarship to play football and attend Kansas State University in Manhattan, Kansas where he was a four year starter at wide receiver and a key component to what has been called “the greatest turnaround in college football history!” The rise of Kansas State’s football program to national prominence during Andre’s tenure under esteemed head coach Bill Snyder is now legendary. While playing football at Kansas State, Andre earned the respect of and developed close relationships with Bill Snyder as well as many of Coach Snyder’s assistants who have gone on to become successful head coaches at some of the most elite football programs in the nation including Bob and Mike Stoops at Oklahoma University and the University of Arizona, respectively.

A Kansas State team captain, Andre led the Wildcats to a 52-17 Copper Bowl victory over Wyoming in 1993. In that game, he was named the Copper Bowl Most Valuable Player after having an incredible game….8 receptions for 144 yards, a receiving touchdown, a 68 yard punt return for a touchdown and a Copper Bowl record 283 all-purpose yards. Andre was selected 1st Team All Big 8 as a wide receiver and kick returner and was named All-America by the Associated Press. Nearly 15 years after graduating from Kansas State, he stands 2nd in Kansas State history for career all-purpose yards.

In 1993, Andre was drafted in the 3rd Round of the NFL Draft by the San Diego Chargers. (70th overall player selected). During his five year career (first 3 seasons with the Chargers and last 2 seasons with the Pittsburgh Steelers), he became one of the NFL’s premiere kick returners and still holds several Super Bowl records to this day. He was named to the 1994 NFL All-Rookie Team and helped lead the San Diego Chargers to the 1994 AFC Championship and a birth in Super Bowl XXIX against the San Francisco 49ers. In that Super Bowl, Andre set an incredible 8 Super Bowl records including a 98 yard kickoff return for a touchdown…at the time, the longest kickoff return for a touchdown in Super Bowl History. Andre was twice selected a Pro Bowl Alternate and was selected 4 times as AFC Special Teams Player of the Month. He was also selected 2 times as San Diego Chargers Special Teams Player of the Year.

After retiring from the NFL, Andre moved to Atlanta, Georgia where he became active in residential and commercial real estate. He has also been involved in many successful business ventures there including ownership of Club Fuel and Babylon, two very successful and extremely popular Atlanta nightclubs. He is currently developing a multimedia website, Addicted2Ent.com. At every level, Andre has excelled. He now wants to provide guidance to the new generation of NFL athletes. Andre partnered with Barrett Brooks and Tim Rogers to create New Era Sports Consultants, designed to take sports representation to another level.

Barrett Brooks was born in St. Louis, Missouri. He attended McCluer North High School where he was honorable mention All-State in football and a varsity letterman in basketball.

 

Like partner, Andre Coleman, Barrett received a full scholarship to play football and attend Kansas State University in Manhattan, Kansas where he also was a key component in “the greatest football turnaround in college football history”. He anchored the offensive line for a Kansas State team that led the Big 8 Conference in passing offense in 1994. Barrett was named 1st team All-Big 8 and 2nd team All-America. He was honored with a selection to play in the Senior Bowl, reserved for the elite senior college football players in the nation, and was also invited to the East-West Shrine Game.

Barrett was selected by the Philadelphia Eagles in the 2nd round of the 1995 NFL draft (58th overall). He started 46 of 64 games during his first 4 seasons with the Eagles. Barrett played his final 4 NFL seasons with the Pittsburgh Steelers and capped off a long and illustrious career with a key block to spring Ben Roethlisberger for a touchdown in Super Bowl XL, helping the team to a Super Bowl victory and earning him a coveted Super Bowl ring. He played 12 total seasons in the NFL (the average tenure in the NFL is less than 4 years) before retiring in 2007 and becoming a partner in New Era Sports Consultants along with Andre Coleman and Tim Rogers.

Barrett was an NFL success story due to his incredible athletic skills and an undying work ethic. But he is also articulate, intelligent, extroverted and a natural leader. All of these qualities provided Barrett with opportunities and experiences “outside the sidelines” not offered to most NFL players. Barrett was sought after in the community for stints as a television and radio host, interviewer and broadcaster. A rather large “heart” also drew him to be active in community affairs and in charity.

Barrett brings a wealth of life and career experiences and knowledge for our family of players to emulate and benefit from during their NFL careers and beyond. Along with the football skills that he worked tirelessly to develop over 12 NFL seasons, Barrett learned innumerable financial and personal lessons as well. He will provide immeasurable guidance and wisdom to young men entering the NFL on how to have the best possible shot at having a long, prosperous NFL career.

Barrett received a Bachelors degree in Arts & Science from Kansas State University. He founded Tackling Together, Inc., a 501(c)(3) organization dedicated to helping disadvantaged youths and their families cope with social and financial challenges. He is also an ambassador to the Heart of a Lion Organization, dedicated to the utilization of mass media to reach out to young Christians.

Introduction

The sports representation landscape has changed significantly. It has become much more complex. You are fooling yourself and perhaps even costing yourself millions of dollars or even your career if you do not have qualified CPA’s and attorneys assisting you with salary and endorsement contract negotiations as well as other financial and legal affairs.

Laziness, ineptitude, incompetence or lack of integrity on the part of your agent clearly translates into a loss at the negotiating table. But your representation goes far beyond contract negotiations. Remember that you are no longer merely an individual earning a paycheck. Rather, you have evolved into a self-employed entrepreneurship…a mid-sized business operation. You need representatives that have also experienced success outside of the agent world and who are familiar with high dollar finance, the Internal Revenue Code and other financial and legal matters.

You need an agent that PAYS ATTENTION!! For example, we just recently took over representation of a 4 year veteran…a former 2nd round draft choice. We found that the player was entitled to $70,000 in state income tax and other refunds from 3 years ago which went overlooked by one of the largest management companies in the world and were shuffled off by the agent (with a long client list) as trivial. That may not be a lot of money to some but to paraphrase the words of an old United States congressman, “$70,000 here and $70,000 there and pretty soon you’re talking about real money.” Remember, it’s your money, not the agent’s, and you need a representative that provides professional guidance to you 24/7, not just until the commission check gets deposited.

At New Era Sports Consultants, we pride ourselves on our attention to detail and the personal attention we devote to each and every one of our player clients. We define our success not by the level of our commissions or the number of our clients but rather by 1) the net worth accumulated by our client’s by the end of their NFL career (i.e. the player’s financial security), 2) the preparedness of our player clients for a career after football and 3) the overall happiness, fulfillment and personal growth of our player clients during and after their playing careers. If our player’s are successful, we will be successful as well.

 

Contract Negotiations

With respect to contract negotiations, your agent must not only be competent, but must also be professional, forward thinking, knowledgeable with respect to salary cap issues and nuances of the Collective Bargaining Agreement (CBA), and perhaps most important of all, respected by team management. We are not saying that it is necessarily important that team management likes your agent but respect is critical. Some agents consistently take hard-line approaches in negotiations, hoping to maximize their commissions while alienating team management, and ignoring the long-term best interests of the player in the process. Tenacity can be a virtue in this business but there are times when it must be tempered with creativity and innovation in order to reasonably assure that the player gets maximum payout over his entire career. Selfishness, greed and obstinance on the part of an agent can cost a player a lot of money and perhaps even cut a player’s career short. Do not let that happen to you.

Also, do not let yourself get lost in the crowd of a long client list. An agent should never be excused for incompetent mistakes or lack of attention because he has more important clients to take care of!

In order to determine a player’s market value, a good agent will evaluate not only past negotiations for players of that caliber at that position but will also take into account anticipated future NFL revenue sources, the current salary cap structure and management style of the team and other intangible factors. More simply, we must be able to create our player’s value, sell that value to the team and then creatively work with the team on how, in what form and over what period to transfer that value into the player’s bank account.

An athlete’s professional sports career is relatively short, averaging less than four years. That makes it critical for you to seek marketing opportunities early in your active playing career in order to maximize your endorsement earnings and exposure. We have close relationships with the marketing arms of Nike, Anheuser Busch and others.

Many athletes desire to give back to the community and become involved in a variety of charitable endeavors. Under the appropriate circumstances, this desire can be formalized by setting up a private charitable foundation. If it makes sense for one of our player clients to set up such a foundation, our attorneys will file all the necessary documents, set it up and even help manage and operate it if desired.

For better or worse, a player’s NFL draft level is increasingly based upon NFL Combine and Pro Day performance. Cash Management, Budgeting & Investment Analysis

It is critical to the long term financial security of our player clients that they recognize that their years in the NFL are limited and that they have but a moment to take advantage of what they have worked so hard for and the gift that they have been given. Players must learn to spend money wisely rather than lavishly and to save and invest some of their discretionary income. Many athletes are not sure where there cash is flowing or even if their cash flow is positive or negative. We can help the individual with budgeting and determine the amount of discretionary funds available for investment. Players should also be interested in investments that produce the highest rate of return and produce the smallest amount of tax. We can approach the area of investments as unbiased observers since we do not sell or take commissions on the sale of any investment products. We have established a relationship with A.G. Edwards, a respected investment firm based in St. Louis and licensed by the NFL Players Association.

 

Income Tax & Estate Planning

Income taxes are typically a professional athlete’s single greatest annual expenditure. To give you a common example, one of our player’s who has earned approximately $3 million over a 4 year NFL career, [has] paid over $1.2 million of that in city, state and federal income taxes and social security taxes. As you can see, a million dollar signing bonus is, in reality, more like ½ a million! And if the player manages to save that ½ million until he dies, he may wind up paying ½ of that or more in estate taxes!! The good news is that income and estate taxes are the expenses most susceptible to planning. We advise the athlete of available tax planning techniques for accumulating income and their effects on the player’s personal financial situation. Ideally, the recommendations will enable the athlete to accumulate additional net worth through tax savings. We have a tax attorney on our team and a CPA who managed the wealth management of top corporate executives while at one of the most prestigious tax consulting firms in the world.

Every athlete should plan for life after football. This includes not only accumulating and preserving the wealth amassed during his professional career with sound financial management and taking maximum advantage of all benefits offered through the NFL Players Association, but also includes preparing for a career once his playing days are over.
